Welcome to MarketQuants. These Terms of Use ("Terms") govern your access to and use of the MarketQuants platform, website, and services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms.

1. Acceptance of Terms​

By creating an account, accessing, or using MarketQuants, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our Service.

2. Description of Service​

MarketQuants is a trading platform that provides:

  • Portfolio management and tracking
  • Stock trading capabilities through Alpaca Markets integration
  • Real-time market data and analytics
  • Paper trading (simulated) and live trading options
  • AI-powered portfolio insights and text-to-speech summaries
  • Stock rankings and recommendations

3. Eligibility​

You must be at least 18 years old and legally capable of entering into binding contracts to use our Service. By using MarketQuants, you represent and warrant that you meet these eligibility requirements.

4. Account Registration and Security​

4.1 Account Creation: You must provide accurate, current, and complete information during registration and keep your account information updated.

4.2 Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4.3 API Keys: If you connect your Alpaca trading account, you are responsible for the security of your API keys. We encrypt and securely store your API keys, but you should never share them with anyone.

5. Trading and Financial Services​

5.1 Third-Party Broker: All securities trading is executed through Alpaca Securities LLC, a registered broker-dealer and member of FINRA/SIPC. MarketQuants is not a broker-dealer and does not hold customer funds or securities.

5.2 Trading Modes: MarketQuants offers both paper trading (simulated) and live trading. Paper trading uses virtual money and is for educational purposes only. Live trading involves real money and real financial risk.

5.3 Investment Risks: Trading securities involves substantial risk of loss. You acknowledge that you may lose some or all of your invested capital. Past performance does not guarantee future results.

5.4 Not Financial Advice: MarketQuants provides tools and information but does not provide investment advice, financial advice, trading advice, or any other sort of advice. All trading decisions are made solely by you.

6. User Responsibilities​

You agree to:

  • Use the Service only for lawful purposes
  • Not attempt to gain unauthorized access to any part of the Service
  • Not interfere with or disrupt the Service or servers
  • Not use automated systems or software to extract data from the Service
  • Comply with all applicable laws and regulations
  • Not impersonate any person or entity

7. Intellectual Property​

The Service and its original content, features, and functionality are owned by MarketQuants and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

8. Data and Privacy​

Your use of the Service is also governed by our Privacy Policy. We collect, use, and protect your data as described in our Privacy Policy. By using the Service, you consent to our data practices.

9. Third-Party Services and Integrations​

9.1 Alpaca Markets: Trading services are provided through Alpaca Markets. Your use of Alpaca's services is subject to their terms and conditions.

9.2 OpenAI: We use OpenAI's services for text-to-speech features. Your interactions with these features are subject to OpenAI's terms of service.

9.3 No Liability: MarketQuants is not responsible for the availability, accuracy, or content of third-party services.

10. Disclaimers and Limitation of Liability​

10.1 AS-IS Basis: THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10.2 No Guarantee: We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free. We do not guarantee the accuracy or reliability of any information obtained through the Service.

10.3 Trading Risks: You acknowledge that trading involves risk and that you may lose money. MarketQuants is not responsible for any trading losses you may incur.

10.4 Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, MARKETQUANTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

11. Indemnification​

You agree to indemnify, defend, and hold harmless MarketQuants and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another.

12. Termination​

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease.

13. Changes to Terms​

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

14. Governing Law and Dispute Resolution​

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
